Terms of Service

1. Acceptance of Terms

By accessing or using the Scenelight platform ("Service") at scenelight.app, you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a fire department or organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Scenelight is a web-based platform designed for fire department operations management. The Service includes modules for incident reporting, time tracking, vehicle inspections, communications, calendar management, billing, and analytics. The Service is provided on a subscription basis to fire departments and related organizations.

3. Accounts and Access

Department administrators are responsible for:

  • Creating and managing user accounts for their department members
  • Maintaining the accuracy of account information
  • Ensuring that each user's access is appropriate for their role
  • Promptly revoking access for members who leave the department

Users are responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious software, viruses, or harmful code
  • Share, resell, or sublicense access to the Service without authorization
  • Use the Service to store or transmit content that infringes intellectual property rights

5. Data Ownership

Your department retains ownership of all data entered into the Service ("Customer Data"). We do not claim ownership of Customer Data. We are granted a limited license to use Customer Data solely for the purpose of providing and improving the Service. You may export your Customer Data at any time through the platform's built-in export features.

6. Payment and Billing

Subscription fees are billed on the terms agreed upon at the time of enrollment. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' advance notice. Failure to pay may result in suspension or termination of access to the Service.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCENELIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

10. Indemnification

You agree to indemnify and hold harmless Scenelight and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

11. Termination

Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate access immediately if you violate these Terms or if required by law. Upon termination, your right to use the Service will cease. We will retain your Customer Data for 90 days following termination, during which time you may request an export. After 90 days, Customer Data will be permanently deleted.

12. Changes to Terms

We may modify these Terms at any time. We will notify account administrators of material changes via email at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in West Virginia.
